Driver faces charges of vehicular manslaughter for fatal car accident.
A 25-year-old San Diego man has entered a plea of not guilty in the car accident death of a pedestrian.
According to reports, Lawrence Joseph Farry was allegedly speeding when he struck 56-year-old Joan Milazzo as she was crossing the 14900 block of Camino Del Sur near San Dieguito Road on the morning of August 30th. Milazzo was taken to a nearby hospital, where she died a short time later of her injuries. Prior to the accident, Ms. Milazzo had been out hiking in the area with her husband.
San Diego police say Farry was going approximately 81 miles per hour in a 50-mph zone at the time the fatal collision occurred. Law enforcement officials investigated the accident for nearly a month before turning their evidence over to the district attorney’s office for review. The SDPD recommended a felony charge in the case was necessary since Mr. Farry had acted negligently by substantially exceeding the posted speed limit.
After reviewing the case, the San Diego District Attorney’s office opted to charge Mr. Farry with a single county of gross vehicular manslaughter. Under California law, Mr. Farry could face up to ten years in state prison if convicted of the felony charge. Because he lacked a prior criminal record, Mr. Farry was allowed to be released on his own recognizance but was ordered not to drive while awaiting trial. A preliminary hearing is scheduled for January 31st, 2012.
This unfortunate incident demonstrates how quickly a car accident can occur. While Mr. Farry may not have intended to kill Ms. Milazzo, his reckless actions resulted in her death.
